Eligibility details
1. From the commencement of the calendar year 2019, customer may register through the LANDMARK Mobile App (“Mobile App”) or by invitation to join the Programme and become a LANDMARK BESPOKE customer subject to the final approval of Hongkong Land and the fulfillment of the relevant terms and conditions.
2. Application to join the Programme is nonetheless subject to the final approval by Hongkong Land and Hongkong Land will designate the tier recognition to eligible LANDMARK BESPOKE customers from time to time at its sole discretion, and Hongkong Land reserves the absolute right to withdraw any invitation or reject any application without providing any reason or notice whatsoever. The eligibility for joining the Programme and the designation of tier recognition are at Hongkong Land’s sole discretion at all times. Hongkong Land’s decision on whether any customer is or is not eligible for the joining the Programme or designation of tier recognition for the Programme is final and binding on all customers, and is not open to challenge.
This Programme is across LANDMARK in Hong Kong, One Central in Macau, and WF Central in Beijing, PRC. To enjoy the overseas benefits and privileges under this Programme, customers are required to give consent in the prescribed consent form of Programme for transferring the customer’s personal data overseas. For the benefits and privileges of One Central in Macau and WF Central in Beijing, PRC, please refer to the respective terms and conditions of the Programme for One Central in Macau and WF Central in Beijing, PRC.
3. Required documents: For the purpose of application to join the Programme, customers are required to provide their full name, the name as appeared on their credit card, email address and mobile phone number as well as documents for proof of identification and/or verification purposes. The documents will only be used for identification and/or verification purpose. Hongkong Land will not make copies of such documents for customer origins at Hong Kong. Customers’ contact details, including the postal address, email and mobile phone number will be used for receiving Programme communications from Hongkong Land including those notifications relating to the current and future Programme period, eligibility of membership tiers and benefits, tier upgrade, rewards and redemption notification (including redeemed points, remaining points and expiry dates), electronic vouchers and their redemption, update on personal data confirmation, and relevant information related to the Programme. Should an applicant fail to provide any of the aforementioned items, Hongkong Land may be unable to process or accept the application.
4. For the avoidance of doubt, all the Reward Points accumulated prior to the commencement of calendar year 2019 in any programme held by LANDMARK BESPOKE or other related programme will be treated as null and void and of no further effect as of the end of calendar year 2018, and no such Reward Points will be carried forward to the Programme effective from the commencement of calendar year 2019.
5. For each of the customer who has applied to join the Programme and who has been approved by Hongkong Land to become an eligible LANDMARK BESPOKE customer save and except for BESPOKE Crystal customer, such eligible LANDMARK BESPOKE customer may (in addition to that eligible LANDMARK BESPOKE customer’s own name) register the name of only one additional person (“additional person”) for earning Reward Points and redeeming rewards under the Programme under that eligible LANDMARK BESPOKE customer’s account subject to these Terms and Conditions. For the purpose of registering the additional person, the additional person is required to provide his/her full name, the name as appeared on his/her credit card, email address and mobile phone number as well as documents for proof of identification and/or verification purposes. The name printed on the relevant receipts and the corresponding electronic payment slips must be the same as the name of that additional person registering for the Reward Point. At any given time, only one additional person is permitted to be registered by any eligible LANDMARK BESPOKE customer under that eligible LANDMARK BESPOKE customer’s account. For the avoidance of doubt, the additional person does not amount to an eligible LANDMARK BESPOKE customer under the Programme and that additional person is not entitled to add any additional person under these Terms and Conditions.
An eligible LANDMARK BESPOKE member may withdraw its membership from the Programme subject to Hongkong Land’s approval. An eligible LANDMARK BESPOKE member may withdraw the nominated additional person from the Programme and any representative authorised by the BESPOKE member to handle the member’s account subject to Hongkong Land’s approval.
Privileges & Rewards
6.1 For the period from the commencement until the end of the calendar year 2019 (but excluding the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme) (both days inclusive), eligible LANDMARK BESPOKE customers of the Programme who make purchase of HK$100 or more by electronic payment (which being credit card or EPS payment) in a single transaction at any retail outlets in LANDMARK ATRIUM, LANDMARK PRINCE’S, LANDMARK ALEXANDRA, LANDMARK CHATER, Exchange Square, Jardine House, or The LANDMARK Mandarin Oriental (Amber, MO Bar and Please Don't Tell Bar only) in Hong Kong, One Central in Macau and WF Central in Beijing, PRC between the commencement until the end of the calendar year 2019 (but excluding the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme) ) (both days inclusive) (“Qualified Spending”) are entitled to bring their receipts for registration and accumulation purposes at the respective retail mall in which such Qualified Spending was made during this period in order to redeem rewards (subject to stock availability, according to eligible LANDMARK BESPOKE customer’s respective tiers and on a first-come-first-served basis) set out in these Terms and Conditions. Eligible LANDMARK BESPOKE customers must submit request for reward redemption on or before the end of the calendar year 2019. For the avoidance of doubt, all the Reward Points accumulated during the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme will be treated as null and void, and no such Reward Points will be carried forward to any other programme nor being eligible for redeeming any rewards under the Programme or other programme whatever.
6.2 Eligible LANDMARK BESPOKE customers must bring their receipts of Qualified Spending at LANDMARK for registration within 30 days from the issuance date of the relevant receipt. Receipts which were issued prior to the joining date of eligible LANDMARK BESPOKE customers to the Programme are not eligible for registration.
For Qualified Spending at One Central in Macau and WF Central in Beijing, PRC, eligible LANDMARK BESPOKE customers must bring their receipts of Qualified Spending for registration within 7 days from the issuance date of the relevant receipt.
7.
Reward Points
7.1 Each receipt of a single transaction with spending more than HK$100 is eligible to accumulate points pursuant to the earn rate which being every HK$1 in Qualified Spending at LANDMARK corresponds to 1 reward point in the Programme (“Reward Point”), unless otherwise specified. Reward Points must be accumulated as whole numbers in each single transaction and any cents in the Qualified Spending will not be counted. Notwithstanding anything to the contrary in these Terms and Conditions, Reward Points (or any Bonus Point Reward) earned from one single transaction / receipt will be capped at 10,000,000 Reward Points. For the avoidance of doubt, the maximum points for jewellery and watches to be earned by each eligible LANDMARK BESPOKE customer of the Programme will be capped at 10,000,000 Reward Points in one calendar year. All those Reward Points which exceeded the relevant maximum limit will not be eligible for registration, accumulation and redemption of rewards under the Programme. Eligible LANDMARK BESPOKE customer may redeem a designated reward or experience with the requisite Reward Points as may be designated by Hongkong Land from time to time. Hongkong Land reserves the right to change the classification of the Reward Point or the basis on which the Reward Points are earned at any time without notice. Reward Points once registered cannot be revoked or cancelled at any time despite that the Qualified Spending could have entitled the eligible LANDMARK BESPOKE customer to earn more Reward Points as a result of any change in the basis on which the Reward Points are earned.

7.2 All reward redemptions are to be made by eligible LANDMARK BESPOKE customer’s request to Hongkong Land and are subject to the accumulation of the designated amount of Reward Points and Hongkong Land’s final acceptance. In the event of inadequate Reward Points, eligible LANDMARK BESPOKE customer’s request for reward redemption will be automatically cancelled. All requests for reward redemption by eligible LANDMARK BESPOKE customers cannot be exchanged for cash (including money or money’s worth), cannot be revoked or cancelled by eligible LANDMARK BESPOKE customers nor any claim for cash refund.
7.3 Hongkong Land reserves the right at any time to request eligible LANDMARK BESPOKE customers to submit the relevant original and registered receipts (including original corresponding electronic payment slip) and/or such further documents or evidence of the Qualified Spending for verification. In this respect, eligible LANDMARK BESPOKE customers are required to keep all supporting documents for verification purposes by Hongkong Land, if required, for a period of 12 months from the date of registration of the receipt or the end of the Programme (whichever is later).
Recognition
8.1 There are 5 tiers of eligible LANDMARK BESPOKE customers: BESPOKE Crystal Customer, BESPOKE Opal Customer, BESPOKE Pearl Customer, BESPOKE Emerald Customer and BESPOKE Sapphire Customer (collectively referred to as “eligible LANDMARK BESPOKE customers” unless otherwise specifically referred to).
8.2 Subject to BESPOKE Crystal Customer duly registering and accumulating 30,000 Qualified Spending before the end of calendar year 2019 (but excluding the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme), BESPOKE Crystal Customer will be upgraded to BESPOKE Opal Customer on the next working day after the requisite Qualified Spending have been duly registered with Hongkong Land.
8.3 Subject to BESPOKE Opal Customer duly registering and accumulating 200,000 Qualified Spending before the end of calendar year 2019 including the Qualified Spending registered and accumulated under BESPOKE Crystal Customer (but excluding the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme), BESPOKE Opal Customer will be upgraded to BESPOKE Pearl Customer on the next working day after the requisite Qualified Spending have been duly registered with Hongkong Land.
8.4 Subject to BESPOKE Pearl Customer duly registering and accumulating a total of 500,000 Qualified Spending before the end of calendar year 2019 including the Qualified Spending registered and accumulated under BESPOKE Crystal Customer and/or BESPOKE Opal Customer (but excluding the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme), BESPOKE Pearl Customer will be upgraded to BESPOKE Emerald Customer on the next working day after the requisite Qualified Spending have been duly registered with Hongkong Land.
8.5 Subject to BESPOKE Emerald Customer duly registering and accumulating a total of 1,000,000 Qualified Spending before the end of calendar year 2019 including the Reward Points registered and accumulated under BESPOKE Crystal Customer and/or BESPOKE Opal Customer and/or BESPOKE Pearl Customer (but excluding the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme), BESPOKE Emerald Customer will be upgraded to BESPOKE Sapphire Customer on the next working day after the requisite Qualified Spending have been duly registered with Hongkong Land.
In order to maintain at least the same tier of eligible LANDMARK BESPOKE customers in the next calendar year, each tier of eligible LANDMARK BESPOKE customers must continue to register and accumulate the requisite Qualified Spending in the current calendar year, that is, 30,000 Qualified Spending for BESPOKE Opal Customer, 200,000 Qualified Spending for BESPOKE Pearl Customer, 500,000 Qualified Spending for BESPOKE Emerald Customer and 1,000,000 Qualified Spending for BESPOKE Sapphire Customer.
Eligible Receipt registration:
9.1 Eligible LANDMARK BESPOKE customers must personally present the original and eligible machine printed receipt (s) and corresponding electronic payment slips (credit card / EPS payment slip counterfoil) with a matching credit card number, cardface and spending amount to each of the sales receipts and the credit card name as stated on the electronic payment slips must match the name of the eligible LANDMARK BESPOKE customer as registered with the Programme at the following designated location depending on the tier of recognition:

BESPOKE Crystal/ Opal – Concierge counter (2/F, LANDMARK ATRIUM next to York House)

BESPOKE Pearl/ Emerald/ Sapphire – LANDMARK Salon (Shop 214A, 2/F, LANDMARK ATRIUM)

9.2 The receipts will be stamped after registration. Stamped receipt(s) will not be accepted for further registration despite that the Qualified Spending could have entitled the eligible LANDMARK BESPOKE customer to earn more Reward Points as a result of any change in the basis on which the Reward Points are earned. Transactions and payments made by cash and/or Octopus payments will not be accepted for registration and accumulation of Reward Points. For the avoidance of doubt, receipts of any of the followings are NOT accepted: Reprinted or photocopied or duplicated receipts, standalone electronic payment receipts, hand-written receipts, or deposit receipts, damaged receipts; receipts for the purchase of any gift vouchers, coupons, merchant vouchers or credit notes or deposit notes or payments on accounts or any equivalent notes of pre-payment, stored-valued cards or any value added to the stored-valued cards; receipts processed as internet purchases, mail/ fax/ phone orders, charity donations; receipts issued in respect of a transaction that has subsequently been refunded or withdrawn or cancelled or falsified or unauthorized or fraud or abuse or unsettled or forged or fraudulent or unsettled transactions; receipts for charity donations, bank services; receipts showing only a payment of deposit or partial payment.

The name printed on the relevant receipts and the corresponding electronic payment slips must be the same as the name of the eligible LANDMARK BESPOKE customer registering for the Reward Point.

Eligible Receipt registration period:
9.3 Eligible LANDMARK BESPOKE customers must register their Eligible Receipt(s) within 30 days of the date of issuance of the receipt (but excluding the period designated by Hongkong Land as being not eligible for registration and accumulation purposes under the Programme), e.g. for a purchase date of 1st October 2019, the corresponding Eligible Receipt must be registered on or before 31st October 2019. Notwithstanding anything to the contrary in these Terms and Conditions, all Eligible Receipts issued during the period from the commencement until the end of calendar year 2019 must be registered on or before the end of calendar year 2019 for calculating and redeeming rewards.

Required Reward Points for redemption:
9.4 In the event of Hongkong Land’s acceptance of eligible LANDMARK BESPOKE customer’s request for redemption of the relevant redemption reward or BESPOKE experience, the required Reward Points will be deducted from that eligible LANDMARK BESPOKE customers Reward Points accumulated for such redemption.
Rewards Redemption Frequency, Rewards Format and Redemption Process:
9.5 Subject to these Terms and Conditions, eligible LANDMARK BESPOKE customers can choose their redemption rewards at their own will. Once customer has redeemed and registered their redemption reward, no exchange, replacement or return will be allowed.
9.6 Eligible LANDMARK BESPOKE customers who have downloaded and logged in the LANDMARK Mobile App or One Central Macau WeChat App or WF Central WeChat App (collectively “Mobile App”) can redeem the relevant reward(s) by selecting the item, and inputting the quantity needed through the Mobile App, subject to the availability of the reward(s) on a first-come-first-served basis and the accumulation of the designated amount of Reward Points. Moreover, Hongkong Land reserves the right to make available certain rewards which are exclusively available to those customers who are physically and personally present at the retail mall for redeeming such rewards which are not otherwise available on the Mobile App. For rewards that are not able to be redeemed on the Mobile App, eligible LANDMARK BESPOKE customers have to check the availability of the relevant rewards and redeem in person either at the Concierge counter or LANDMARK Salon (depending on the tier of recognition). Eligible LANDMARK BESPOKE customers must attend in person at the designated merchants or outlets during their respective opening hours to use or collect the redeemed reward.
9.7 For the avoidance of doubt, all the Reward Points accumulated under Programme will be treated as null and void and of no further effect if such Reward Points have not been so redeemed under these Terms and Conditions. No Reward Points will be carried forward to any other programme whatever.
General
10. Hongkong Land reserves the right to withhold the registration of receipts and the earning of Reward Points from any transactions or receipts if Hongkong Land suspects that any such transactions or receipts involved any fraud and in such event, the relevant eligible LANDMARK BESPOKE customer’s account is suspended from the Programme until further notice.
11. The Reward Points have no cash value and are not equivalent to money or money’s worth. Reward Points are not exchangeable for cash, credit, other products or services or other benefits. Reward Points cannot be sold, purchased, assigned or transferred by the eligible LANDMARK BESPOKE customer.
12. All redemption rewards are subject to availability and Hongkong Land reserves the right to discontinue any item or to substitute a similar item of equal value at any time without prior notice.
13. Hongkong Land reserves the right to disqualify any participant if Hongkong Land has reasonable grounds to believe the participant has breached any of these Terms and Conditions, or the information provided does not comply with these Terms and Conditions.
14. Hongkong Land reserves the right to recover from any eligible LANDMARK BESPOKE customer the value of the redemption reward if Hongkong Land finds any eligible LANDMARK BESPOKE customer failing to comply with these Terms and Conditions after the redemption reward has been redeemed.
15. Hongkong Land reserves the right to scan or copy shoppers’ machine-printed receipts for internal reference only.
16. All eligible LANDMARK BESPOKE customers must redeem the designated instant reward(s) in person and provide documents of identification if so requested by Hongkong Land. The documents will only be used for identification and/or verification purpose. Sales personnel are NOT allowed to redeem any redemption reward(s) on behalf of the eligible LANDMARK BESPOKE customers.
17. Hongkong Land shall not be responsible to eligible LANDMARK BESPOKE customer or any other party for any liability, loss, damage, claim, cost or expense whatever and howsoever arising in respect of, relating to or in connection with the redemption or the using of any of the redemption rewards.
18. Hongkong Land reserves the right to amend these Terms and Conditions or cancel the Programme at any time without prior notice to the participants or eligible LANDMARK BESPOKE customers. All questions or disputes shall be resolved by Hongkong Land in its absolute discretion. In the event of any dispute, the decision of Hongkong Land shall be final. The decision of Hongkong Land on all matters relating to, or in connection with, the Programme shall be final and binding on all parties concerned.
19. Personal Data Protection:
19.1 For the purposes of this Programme, Hongkong Land needs to collect personal data from the eligible LANDMARK BESPOKE customers, e.g. full name, mobile number and email address . Customers’ contact details, including the postal address, email and mobile phone number will be used for receiving Programme communications from Hongkong Land including those notifications relating to the current and future Programme period, eligibility of membership tiers and benefits, tier upgrade, rewards and redemption notification (including redeemed points, remaining points and expiry dates), electronic vouchers and their redemption, update on personal data confirmation, and relevant information related to the Programme. Failure to provide personal data as requested will result in Hongkong Land being unable to process or accept the registration. Failure to provide or keep up to date the required personal data might result in Hongkong Land being unable to offer the Programme and associated benefits to that eligible LANDMARK BESPOKE customer.
19.2 Hongkong Land may disclose the information collected to such person to whom Hongkong Land is required to make disclosure under the laws of Hong Kong.
19.3 In future, if the eligible LANDMARK BESPOKE customers would like to update or change any of their personal data, or if the eligible LANDMARK BESPOKE customers do not wish to receive such promotional materials from Hongkong Land, please send the request to the Head of Marketing and Communications Department of Hongkong Land through any one of the following channels:

20. In case of discrepancies between the English and Chinese versions, the English version shall prevail.
Personal Shopper Services (“Services”)
“WISHLIST” Terms and Conditions
1. The Services are available to LANDMARK BESPOKE customers who have downloaded and logged in the LANDMARK mobile app (“Mobile App”) on their mobile device only.
2. LANDMARK BESPOKE customers can save selected items of products in their “Wish List” from the product list in the Mobile App and the quantity of saved items is unlimited.
3. A saved item can be deleted by the customers at any time.
4. Product availability at the shops in LANDMARK will not be reflected on the product list in the Mobile App. Products displayed on the Mobile App are subject to availability.
5. All information relating to any product on the Mobile App is provided by the merchants. Hongkong Land will not be responsible for any inaccuracy or incompleteness of any information including but not limited to the description and images of the products, their appearances, colours, textures and finishes displayed on the Mobile App. Hongkong Land will not guarantee that a product’s image is an accurate representation of the actual merchandise.
“STYLE CONCIERGE” Terms and Conditions
1. LANDMARK BESPOKE customers who have logged in the Mobile App can send request to check availability of a saved item on their “Wish List” or other products of interest by uploading a photo to the Mobile App.
2. Customers can send request with their preferred size for a specific item.
3. Hongkong Land will contact relevant merchants to confirm the availability of the specific requested item(s) and send updates to the customer via the Mobile App within 48 hours of the customers’ request.
4. The quantity of requested item is unlimited.
5. The specific requested item(s) may be reserved for customers for a certain period of time based on the latest products availability and popularity confirmed by the merchants. Customers will be notified the actual reservation due date of each requested item.
6. If a reserved item goes out of stock after the reservation due date, then neither Hongkong Land nor the merchants shall be liable to customers for being unable to provide that item.
7. All product prices are in Hong Kong dollar currency and are exclusive of any applicable taxes or service charge. Prices of products may change from time to time. Hongkong Land shall not be responsible for any errors or inaccuracy of all prices of the products displayed in the Mobile App.
8. Hongkong Land makes no warranties, whether express or implied, in relation to accuracy and completeness of the product information and price displayed on the Mobile App. The Mobile App is provided on an “as is” and “as available” basis without any representation or endorsement made and Hongkong Land makes no warranties of any kind, whether express or implied, in relation to the Mobile App, or any request conducted on or through the Mobile App including but not limited to implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness or any implied warranty arising from course of dealing, usage or trade.
9. Hongkong Land shall not be responsible for any matters in relation to the related products or services. The respective merchants are solely responsible for all obligations and liabilities relating to all goods, products, advice or services and all ancillary services offered to customers.
10. Hongkong Land is not the merchant of the goods / services in this Service. Any enquiry or complaint for the quality of the goods or services provided relating to this Service should be directed to the relevant merchants. Hongkong Land shall assume no liability in respect of the goods or services provided by the relevant merchants. The terms and conditions of the relevant merchants shall apply. Please inquire the details with the relevant merchants.
11. Hongkong Land makes no warranty that the Mobile App will meet customers’ requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes the Mobile App available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the Mobile App. Hongkong Land will not be responsible or liable to any customer for any loss or damage in relation to any photo, image, data or material uploaded or transmitted through the Mobile App.
12. Customers shall be liable for the authenticity and legitimacy of the images, photos and data that they shoot, produce, publish or save with the Mobile App. Customers shall not use the Mobile App to produce, save or publish the following contents:
12.1 Obscene pornographic content, the manifestations of which may include but are not limited to publishing obscene, pornographic, indecent or immoral content.
12.2 Copyright infringement, the manifestations of which may include but are not limited to producing, publishing and saving contents infringing on another’s right of reputation, portraiture right, right of privacy, intellectual property rights or other legitimate rights.
12.3 Content constituting unfair competition, the manifestations of which may include but are not limited to releasing content to tamper with, add or delete the identification of rights; publishing content not authorised by the licensor of such images, photos and data.
12.4 Contents that violates the laws, regulations, social order or good customary practices, or interrupts regular operation of the Mobile App and infringes upon the lawful rights of any third party. In case of any aforementioned behavior that violates the laws or infringes upon the lawful rights of others, HKL is entitled to take immediate action, including but not limited to revision and deletion of illegal information and/or submit the matters to the courts for enforcement of the laws.
“PRIORITY DINING” Terms and Conditions
1. For selected LANDMARK BESPOKE customers who have logged in the Mobile App only.
2. The service is only available to a list of selected restaurants at LANDMARK.
3. Customer can send the booking request by entering a specific date, time and number of diners.
4. Customer shall not submit multiple booking requests for a single table booking. In the event of such multiple requests being made, Hongkong Land may at its sole and absolute discretion (i) treat them as a single booking request; or (ii) reject / cancel all such booking requests made by the customer without any compensation or recourse to the customer.
5. Customer may only make a maximum of two booking requests for the same date. The aforesaid limits are subject to Hongkong Land’s adjustment from time to time without prior notice.
6. Subject to items 1 and 5 above, the customer may make a booking request for a third party for non-commercial purpose only. For the avoidance of doubt, resale or attempted resale of bookings is expressly prohibited. Where the customer provides Hongkong Land with information relating to any third party, the customer shall be responsible for obtaining such third party’s prior consent to the disclosure of the same to Hongkong Land, and the customer warrants that such third party has agreed to the collection and the use of the its information in accordance with these Terms and Conditions and the “Hongkong Land Privacy Policy and Personal Information Collection Statements”.
7. Hongkong Land will contact the relevant restaurant to confirm the availability of the specific request. Upon acceptance of the customer’s booking by the relevant restaurant, Hongkong Land will send confirmation (“Booking Confirmation”) to the customer via the Mobile App. For the avoidance of doubt, the Booking Confirmation will serve as the restaurant’s acceptance of your booking of table but may not necessarily indicate its promise to satisfy your special request made under the booking request, if any.
8. The booking request will be refused due to booking schedule of the relevant restaurant. Customer will be notified via the Mobile App if the booking is not successful.
9. Restaurant’s blackout dates apply.
10. Hongkong Land makes no guarantee that any of the customer’s request or variation or cancellation of the request will be timely processed or accepted by the relevant restaurant. Hongkong Land will not be responsible or held liable for any liability whatsoever and howsoever arising from or in connection with any delay in the processing or non-acceptance of customer’s request on the part of the relevant restaurant.
11. Hongkong Land accepts no responsibility or liability whatsoever arising from and/or in connection with the restaurants’ failure to properly and timely fulfill or otherwise act in connection with the customers’ bookings.
12. Hongkong Land shall not be liable for any loss or damage directly or indirectly arising from and/or in connection with the customer’s patronage at the restaurants.
13. Hongkong Land gives no warranty as to the accuracy of the information contained on or given in the Mobile App and accepts no liability arising from any inaccuracy of such information. Any typographical error, clerical or other error or omission on the Mobile App or other relevant information or document provided by Hongkong Land, including without limitation to the Booking Confirmation, shall be subject to correction at any time without any liability on Hongkong Land’s part and Hongkong Land is not obliged to give to the customer any notice in relation to such correction.
“LANDMARK E-GIFT CERTIFICATE” Terms and Conditions
1. For LANDMARK BESPOKE customers who have registered their spending in designated areas of LANDMARK for a specific promotion only.
2. The “Electronic LANDMARK gift certificate” will be issued at the designated redemption counter at LANDMARK.
3. Customers are required to present the “Electronic LANDMARK gift certificate” through the Mobile App.
4. The “Electronic LANDMARK gift certificate” can be used once and only at participating merchants which accept “Electronic LANDMARK gift certificate”. If the value of the item(s) the customer purchases or order exceeds the value of the “Electronic LANDMARK gift certificate”, the customer will be required to settle any additional cost exceeding the value of the “Electronic LANDMARK gift certificate” presented. If the value of the item(s) the customer purchases or orders is less than the value of the “Electronic LANDMARK gift certificate”, no change is allowed for any unused amount in the gift certificate presented and any unused amount will be forfeited.
5. Each “Electronic LANDMARK gift certificate” will be bounded by individual validation.
6. The “Electronic LANDMARK gift certificate” is non-transferable, non-refundable and non-redeemable for cash, credit or other benefits or offers.
7. Hongkong Land shall not be liable for the operations of or the goods, services, products or food items provided by any of the participating merchants in this Service. Any enquiry or complaint for the goods, services, products or food items shall be directed to the relevant participating merchants. The relevant participating merchants shall be solely responsible for all their goods, services, products and food items provided or offered to the customers.
8. The decision of Hongkong Land on all matters relating to, or in connection with, the use of the “Electronic LANDMARK gift certificate” shall be final and binding on all parties concerned.
“CONSECUTIVE 3-HOURS COMPLIMENTARY VALET PARKING BENEFIT FOR BESPOKE SAPPHIRE CUSTOMERS” Terms and Conditions
1. Subject to availability of carparking spaces, the operating hours of the Carpark and these terms and conditions, each valid BESPOKE Sapphire Customer is entitled to a daily single entry to enjoy a consecutive 3-hours complimentary valet parking service once per day (“Valet Parking Benefit”).
2. The Valet Parking Benefit is only available at the Carpark Basement of LANDMARK ATRIUM (B2M/F) or LANDMARK CHATER (B1/F) during the operating hours of the Carpark Basements of LANDMARK. No overnight parking is allowed.
3. The Valet Parking Benefit is available to the valid BESPOKE Sapphire Customer from the commencement until the end of the calendar year 2019.
4. For the avoidance of doubt, the primary account holder of the valid BESPOKE Sapphire Customer account and the additional person nominated by the primary account holder will be treated as one BESPOKE Sapphire Customer only. The additional person nominated by the primary account holder of the valid BESPOKE Sapphire Customer account is not entitled to register any vehicle. There will not be any Valet Parking Benefit for the nominated additional person.
5. Not more than 4 Vehicle Registration Numbers belonging to the BESPOKE Sapphire Customer can be registered with Hongkong Land (“Registered Vehicle”) and only such Registered Vehicle is permitted to enjoy the Valet Parking Benefit. The Registered Vehicle cannot be changed after registration.
6. At any given time, each valid BESPOKE Sapphire Customer will only be entitled to redeem the Valet Parking Benefit for only one Registered Vehicle per day. Only one valid BESPOKE Sapphire Customer account can be used for any redemption of the Valet Parking Benefit for one Registered Vehicle on a daily single entry.
7. For the avoidance of doubt, the 3 consecutive hours under the Valet Parking Benefit must be utilised on a daily single entry and on a consecutive basis per day, and such 3 consecutive hours cannot be broken up and be used separately under any circumstances. If any valet parking service on a daily single entry is less than 3 consecutive hours per day, then any such unused portion of the said 3 consecutive hours will be forfeited upon redemption of the Valet Parking Benefit on that day. Any such unused portion of the said 3 consecutive hours is non-transferable, non-refundable and non-redeemable for cash, credit or other benefits or offers, and cannot be used to set-off or carry forward to settle valet parking service on any other day.
8. The Valet Parking Benefit is limited to 3 consecutive hours per day on a daily single entry. If the valet parking service exceeds 3 consecutive hours, BESPOKE Sapphire Customer will be required to settle any additional charges/cost (at the rate of HK$50 per hour or part thereof) exceeding the benefit of the Valet Parking Benefit redeemed under the Valet Parking Benefit.
9. For redemption of the Valet Parking Benefit and payment, valid BESPOKE Sapphire Customers are required to provide BESPOKE Sapphire Customer phone number and vehicle registration number of the Registered Vehicle together with the valet parking ticket at LANDMARK ATRIUM (B2M/F) or LANDMARK CHATER (B1/F) to verify the identity of the BESPOKE Sapphire Customer status and the Registered Vehicle and to redeem the Valet Parking Benefit. If any of the phone number, vehicle registration number of the Registered Vehicle or the parking ticket is not provided for any reason whatever, BESPOKE Sapphire Customers cannot enjoy the Valet Parking Benefit under any circumstances, and BESPOKE Sapphire Customer must settle all charges/cost for the valet parking service.
10. The Valet Parking Benefit is non-transferable, non-refundable and non-redeemable for cash, credit or other benefits or offers. The Valet Parking Benefit does not include any other incidental expenses.
11. The Valet Parking Benefit is subject to the rules, regulations, terms and conditions from time to time applicable to Carpark Basement of LANDMARK ATRIUM (B2M/F) or LANDMARK CHATER (B1/F) and the valet parking service.
12. Hongkong Land reserves all rights to suspend or terminate the Valet Parking Benefit and/or the valet parking service at any time without notice. No compensation whatever is payable to any customer in respect of such suspension or termination.
13. Hongkong Land will not accept any responsibility for the loss or damage however caused to any motor vehicles or property therein, while parked on the Carpark Basement of LANDMARK ATRIUM (B2M/F) or LANDMARK CHATER (B1/F) or in utilising the valet parking service.
14. The decision of Hongkong Land on all matters relating to, or in connection with, the use of the Valet Parking Benefit and the valet parking service shall be final and binding on all parties concerned.
15. Hongkong Land reserves all rights to cancel or amend these terms and conditions without notice.
16. In case of any disputes arising out of these terms and conditions, Hongkong Land reserves the right of final decision.
“OTHER PARKING BENEFIT FOR BESPOKE EMERALD, PEARL AND OPAL CUSTOMERS” Terms and Conditions
1. Subject to availability of carparking spaces, BESPOKE Emerald Customers are entitled to 3 valet parking vouchers of HK$200 each per month.
2. Subject to availability of carparking spaces, BESPOKE Pearl Customers are entitled to 2 valet parking vouchers of HK$200 each per month.
3. Subject to availability of carparking spaces, BESPOKE Opal Customers are entitled to 1 valet parking vouchers of HK$200 each per month.
4. BESPOKE Emerald Customers, BESPOKE Pearl Customers and BESPOKE Opal Customers are bound by the rules, regulations, terms and conditions from time to time applicable to Carpark Basement of LANDMARK ATRIUM (B2M/F) or LANDMARK CHATER (B1/F), the valet parking service and as stated in the valet parking vouchers.
General Terms and Conditions for the Services
1. Hongkong Land shall not in any way be regarding as the customers’ agent in rendering the Services.
2. The customers shall not assign or transfer any rights or obligations under these Terms and Conditions to any third person without Hongkong Land’s prior written consent.
3. The Mobile App is available to mobile devices running Apple iOS and Android OS operating systems. Hongkong Land will use reasonable efforts to enable availability of Mobile App at all times. The customers acknowledge that functions and features of the Mobile App will only be available when the customers’ mobile device is connected to the Internet, mobile networks, WiFi and/or bluetooth network. Accordingly, the quality and availability of the Mobile App may be affected by factors outside Hongkong Land’s reasonable control.
4. Hongkong Land and its officers, employees, agents, contractors or sub-contractors do not accept any responsibility whatsoever for unavailability of the Mobile App, or any difficulty or inability to download, upload or access content or any other communication system failure which may result in the Mobile App being unavailable.
5. Hongkong Land will not be responsible for any support or maintenance of the Mobile App.
6. In no event shall Hongkong Land, its officers, employees, agents, contractors or sub-contractors be responsible to you or any other person for any direct, indirect, incidental, special, punitive, exemplary or consequential loss or damage whatsoever arising out of your use or access to or inability to use the Mobile App (including without limitation unauthorised access using your username and password or transmission of content or any transactions entered into through the Mobile App).
7. Hongkong Land shall not be liable to you for any damage or alteration to your electronic equipment including but not limited to computer equipment, mobile device or iPad or tablet as a result of the installation or use of the Mobile App.
8. Whilst Hongkong Land takes reasonable precaution to ensure that the Mobile App are free from computer viruses or other harmful elements, Hongkong Land expressly disclaims any liability for any loss or damage caused as a result of such computer viruses or other harmful elements.
9. Where the Mobile App provides links to third party website, these are provided solely as a convenience to you, and they are not affiliated to HKL. Such websites shall not in any way be regarded as an endorsement of any kind by HKL approving the contents thereon. If you access any linked third party websites, you do so entirely at your own risk. HKL neither takes any responsibility for nor makes any representations, warranties or undertakings (whether express or implied) as to their availability and the contents contained in third party websites. Any questions or comments relating to such third party websites shall be addressed to the operators or owners of those websites.
10. Hongkong Land does not guarantee uninterrupted, continuous and/or secure access to the Mobile App. Part of the Mobile App may be unexpectedly unavailable for whatever duration and for whatever reasons that may include but not limited to system malfunctions and disruptions, Internet access downtime and other technical problems beyond Hongkong Land’s control for which Hongkong Land cannot and shall not be held responsible. The customers agree that their use of the Mobile App is at their own risk and that the customers will not hold Hongkong Land responsible for any damage or loss caused by the customers’ inability to use the Mobile App for any reason whatsoever. Hongkong Land reserves the right to take any part or the whole of the Mobile App offline with or without notice for reasons including but not limited to system maintenance or upgrading.
11. Although Hongkong Land will use its reasonable endeavours to restrict access to the database of the users’ personal data only to Hongkong Land’s personnel and/or its affiliates, Hongkong Land does not guarantee that other parties will not, without HKL’s and/or its affiliates’ consent, gain access to such database. For Hongkong Land’s policies regarding the usage and protection of personal data provided by any user of the Mobile App, please refer to “Hongkong Land Privacy Policy and Personal Information Collection Statements”.
12. Hongkong Land reserves the right to amend these Terms and Conditions or cancel the Services at any time without prior notice to any customer. All questions or disputes shall be resolved by Hongkong Land in its absolute discretion. In the event of any dispute, the decision of Hongkong Land shall be final. The decision of Hongkong Land on all matters relating to, or in connection with, the Services shall be final and binding on all parties concerned.
13. In case of discrepancies between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.
